In Arizona:

  1. So, is the car owner advertising that he/she is in the country illegally? Then perhaps he/she should be interviewed, detained and shipped back to whence they came. If the car owner is a citizen of the USA, the proper label should be “I’m a US citizen, don’t bother me.”
    Don’t see what the big deal is, when law enforcement is seeking mafia types they generally ask around for caucasian people with last name ending in vowels.
    Looking for klan members, generally the FBI leaves “people of color” out of the search parameters.
    Don’t know many white guys in the crips, bloods or Tong.
    I can think of many more examples, none of which are illegal, or considered profiling.
    Not many illegal alien Irish or Norwegions in Arizona, but for some reason the 500,000 (estimated) illegal hispanics consider it bad form if the local PD asks a guy named Paco Morales, who just got pulled over for a DUI, or wreckless driving, if he is supposed to be in Arizona, and is that he real SSN.
    Don’t see any civil rights issue at play here, just a bunch of liberal democrats pandering to new potential voters.

  2. Except its not getting stopped for a DUI-its getting stopped while driving legally. I see the issue with this law as redefining the idea of “probably cause”.

    Using the logic of the Arizona law, I can start arresting white Alabaman’s on the street for sedition then-as most tea baggers are white, southern and stupid-which fits the demogrpahic here in Dullsville quite nicely.

    The example of the guy who gets stopped for DUI-he ought to have his citizen ship checked. And if he is illegal he gets sent packing. But to get stopped for DUI is that you have to present some reason to appear impaired-e.g. violating traffic laws.

    P.S. You do not have to be a citizen to have an SSN. The S.O. has an SSN and she is just a green card holder. ( And green cards are neither green nor are they cards).

  3. Well I happen to think DUI checkpoints don’t pass muster with the 4th Amendment. Just as drug tests don’t either-but there has never been a successful challenge.

    And don’t even get me started on the BAC limit. .08 was just a way for states to make money.

  4. Everything I’ve read abot the AZ lasw says the PD must have probable cause, no different than states where a no seat belt ticket can only be given if the vehicle is stopped for another violation (speeding, running a light).
    I said real SSN, what I should have said was “Valid”, and if a person is here illegally then the SSN cannot be valid.
    I assume in Japan they don’t protect their borders, let anyone in, never ask non asian looking folks for their passports/visa, and have millions of illegal aliens living under the radar,
    The Tea Partiers are not criminals, the illegal aliens are.
    Concur with Curtis, DUI stops are common, and totally legal. You smell like alcohol, you get a field sobriety test and a breathalizer, you fail the test, then we can run your name, DOB and SSN, to see if you match up, if not then ICE gets a call.
    My only big worry is that the current administration will tell ICE to ignore this AZ issue,

  5. No-in Japan they are even worse than Arizona. You get checked on the way in and on the way out. You get fingerprinted. You get a foreigner ID card.

    But they do have a problem with illegal Chinese living in their midst-who come in via Yakusa sponsor ship.

    As for Tea Partiers not being criminals-well wait till I take control. They will be then. 🙂

  6. Again, what is the big deal with carrying tamper resistance ID?
    Some police DO have the authority to ask for “immigration papers” via a special program that ICE runs. They are empowered, in this instance, to act as agents of the feds.
    I propose that we treat illegal MEXICANS just like the Mexicans treat THEIR illegal immigrants. This fairness doctrine should please that narco state of Calderon eh?

If the local PD has a reasonable suspicion, (DUI, other traffic issue, arrest you for a B&E, whatever ) then if you don’t have ID as a US born citizen they will hold you until they get an ID, because you are suspected of committing a crime. Prove your citizenship, then the ICE turnover is off the table, you just get run through the system for your original arrest.
    You are correct, US citizens are not required to have ID, but if you commit a crime you get photographed and fingerprinted.
    I can prove my citizenship with my Driver’s ID, the PD run it and find out that I’m a Yankee from PA.
    Legal immigrants, by law, need to carry their “greeen card” if not they are in violation and SHOULD BE detained.
    Paco gets stopped after running a red light, he doesn’t have a valid DL, so the PD have PC for further investigation.
    No problem that I see.
    Richard has a point,you can get shot if the Federales catch you sneaking North from Central America into the Yucatan.

    Only please stop talking to me about American exceptionalism-because it no longer exists. We will be acting the same as France, China, and/or any country in Southeast Asia.

    A couple of points about driver’s licences though. All running your licence really proves is that you have presented and SSN to the DMV-and that you are a legal resident of this country. ( The S.O. has both an SSN and a Driver’s license). If they ran her licence all they would know is that she is a green card holder and lives in Alabama. The trail stops there.

    The S.O. does not carry her green card with her-for the same reason I don’t carry my passport with me overseas. Losing it is worse than not having it if stopped.

    The real issue with immigration is two fold IMHO. One-you have to be fairly certain the more times you roll the dice you are going to get caught. That’s how they keep DUI’s down. Its not that I can’t have 5 beers and get in the car and get home-its that nagging feeling the road nazis will catch up with me that stops me from doing it and taking a cab. The same has to happen with immigration. Which means that there has to be a an accpetance of a loss of privacy that we never accepted before.

    But the second issue is that we need to make it hard to employ illegal aliens. Go after the people who employ them-and force the wage standard to go up to pay legal workers-it disincentives people coming here. Maybe un-fucking Mexico would help too. Maybe we invaded the wrong country instead of Iraq.

  9. How does an employer know who is a citizen, green card holder or?

    Its VERY easy to get fake documents.
    EVERYONE knows that. so what is an honest employer to do since some folks, on the right and the left, have a problem with tamper proof/biometric ID?
    By the way, here in the Garden State they require various forms of ID before they will issue a DL., like birth certificate, certain utility bills etc.
    Why should Mexico help?
    And what does it say about Mexico that so many of its citizens vote with their feet and NO one is more nationalistic than a Mexican. ( I lived in California for ten years..LA, Hawthorne, Victorville)
    They are very proud of their heritage and rightly so, though ill served by the elite in Mexico.
